After reading through your chapter 4 reviews I wanted to answer the questions you had.
1.Symbolic v Free speech – Both are protected by the 1st Amendment … free speech is actual speech but symbolic speech is an actual action.
2.Due Process – Everyone must follow the same processes when their rights are taken away from them, courts are just one part of that process.
3.Obscenity – is not protected speech, whether symbolic or not and is determined by the local community.
4.Physician Assisted Suicide – Like any form of suicide this is illegal and not allowed in the United States.
5.Imminent lawless action – Remember, for this to be illegal it must have two components. First, actual speech or words that get people ready to commit some sort of lawless action and second something actually has to be able to happen. Ex: Many songs encourage lawless action but the song writers and singers are not violating the law because it is never expected that someone will act based on the song.
6.Habeas Corpus – When a person has been arrested he is entitled to find out what the charges are against him and what evidence there has been collected against them. This is where bail is determined and may also be known as someone’s 1st appearance.
7.14th Amendment – Among the many things accomplished by the 14th amendment you can find a better description of due process from the 5th Amendment; you can find citizenship determined; you can find selective incorporation. This amendment was first utilized to reinforce the 1st Amendment only but by the 1960’s all parts of the Constitution, including its amendments, are considered fundamental and thus protected.
